US Based Managed Hosting Terms and Conditions

If you’re using MindChip Industries US based managed hosting services, the following conditions apply:

By choosing our hosting platform, you authorize us to access your website and its database for essential operations such as hosting, maintaining, and backing up your content.

When we identify a potential security issue, we’ll first notify you. Depending on the situation, we may apply necessary updates or directly remove harmful code to protect your website.

We occasionally analyze stored data to produce internal, non-identifiable statistics that help improve service speed, stability, and security.

You retain ownership of all site content and data. However, you grant us a non-exclusive, worldwide, royalty-free license that allows us to copy and store only what’s required to operate and maintain your hosting services.

By using our service, you also authorize us to gather and combine firewall IP information, which supports better detection of security risks and improved protection for all hosted websites.

Our objective is to maintain perfect uptime—ensuring sites remain accessible at all times. Still, if unplanned downtime occurs, the following Service Level Agreement (SLA) applies:

  • We commit to 99.9% uptime each month.
  • No fixed limits exist on bandwidth, visitor counts, or traffic. However, unexpected traffic spikes (whether legitimate or automated) can cause slowdowns or outages. If this happens, we’ll notify you about potential upgrades to prevent future issues. The SLA does not cover downtime caused by capacity limits.
  • If uptime drops below the guarantee in a calendar month, you may request SLA credit within 30 days of that month’s end. Credits equal 5% of the monthly hosting fee per full hour of downtime beyond the SLA, capped at the total monthly charge. Downtime measurements are based on our monitoring systems.

The SLA includes downtime due to errors caused by our team or by the third-party providers we partner with to deliver hosting services.

The SLA excludes interruptions resulting from external factors beyond our control—such as third-party software bugs, user mistakes, or natural disasters.

API-Based Services

Certain MindChip Industries features rely on API integration to unlock full functionality. These include (but aren’t limited to) MindChat Chatbot, Image Accelerator, Speed Me Up Scotty, the Client Hub, Total Website Security, the MindChip Dashboard Plugin, and SEO Authority.

If you make use of any of these API-powered services, the following conditions apply:

  • An active MindChip Industries subscription is required to access and use any API service.
  • Only approved MindChip plugins are permitted to connect to our APIs. Each connection requires a unique API key assigned to your account. You may use your key only on websites you own or manage for clients. Sharing, reselling, or posting your key publicly is strictly prohibited.
  • Breaching these terms can result in immediate suspension of API access and/or cancellation of your WPMU DEV account.
  • We may temporarily pause or restrict API access if we detect exceptionally high or irregular request volumes that could degrade performance for other users.
  • You’re free to install our plugins on any number of personal or client sites. However, for auto-updates and dashboard support via the MindChip Dashboard Plugin, a soft usage limit applies to prevent fraudulent or abusive behavior. If you reach that limit, contact our support team to review or extend your access.
  • When you activate the Total Website Security plugin, you give us permission to access and combine firewall IP data to help identify threats and strengthen protection across all sites secured by this service.
  • Using the Broken Link Checker cloud system means you consent to allow our crawler to scan publicly visible pages to detect and gather URLs. For authentication and security, the plugin communicates with the Client Hub and securely stores identified links and their corresponding locations there. This data powers reporting and link management tools within your dashboard.
